Terms of Use

Thank you for using the TheHouse48 App ("Dream Account" or the "Service"). These Terms of Service ("Terms") govern your access to and use of the TheHouse48 website, apps, APIs, and widgets. Please read these Terms carefully before accessing or using Dream Account. By accessing or using Dream Account, you agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and any future modifications.

1. Our Service

Dream Account is a visualization platform that allows you to explore home designs, dream destinations, and create a lifestyle you desire. Some content is promoted by users. We strive to ensure that promoted content remains relevant and interesting to you.

2. Using Dream Account

a. Eligibility
You must be able to legally form a binding contract with TheHouse48 Inc. and comply with all applicable laws to use Dream Account. Access is prohibited for anyone under 13 years old or under the age of majority in their jurisdiction. By using Dream Account, you confirm you meet these eligibility requirements.

b. License
Subject to these Terms and our policies, we grant you a limited, non-exclusive, non-transferable, revocable license to use Dream Account.

c. Commercial Use
For commercial use of Dream Account, you must create a business account and agree to our Business Terms of Service. Using Dream Account commercially without a business account constitutes a violation of these Terms.

3. Your Content

a. Posting Content
You retain ownership of any content you post on Dream Account ("User Content"). However, you are solely responsible for such User Content.

b. License to Your Content
By posting User Content, you grant TheHouse48 and our users a worldwide, royalty-free license to use, reproduce, modify, distribute and create derivatives of your User Content solely for operating, developing and providing Dream Account. We may remove or modify User Content that violates these Terms, our Guidelines, or policies.

c. Content Retention
After account termination or User Content removal, we may retain your User Content for backup, archival or legal purposes. Other users may also continue using, storing or distributing any of your shared User Content.

d. Feedback
Any feedback, comments or suggestions you provide are considered non-confidential, and TheHouse48 is free to use such input without compensation or attribution.

4. Copyright Policy

TheHouse48 has implemented a Copyright Policy in accordance with the Digital Millennium Copyright Act and other applicable laws. Please refer to our Copyright Policy for more information.

5. Security

While we strive to protect your account's security, Dream Account cannot guarantee unauthorized third-party access. You are responsible for keeping your password secure and notifying us promptly of any unauthorized account access.

6. Third-Party Links and Services

Dream Account may contain links to third-party websites, services or content not owned or controlled by TheHouse48. We do not endorse or assume any responsibility for such third-party resources. You access them at your own risk.

7. Termination

We may terminate or suspend your Dream Account access for any reason with appropriate notice, or immediately without notice if you violate our Community Guidelines or these Terms.

8. Indemnification

If you use Dream Account for commercial purposes without a business account, you agree to indemnify and hold harmless TheHouse48 Inc, its affiliates, officers, directors, employees and agents from any claims, damages, losses or expenses arising from your use of Dream Account or breach of these Terms.

9. Disclaimers and Limitations of Liability

Dream Account is provided "as is" without warranties of any kind. TheHouse48 disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any User Content or third-party conduct on Dream Account.

To the maximum extent permitted by law, TheHouse48 shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use or inability to use Dream Account.

10. Dispute Resolution

For any disputes, you agree to first contact us for an informal resolution. Unresolved claims shall be subject to binding arbitration or small claims court, except for claims seeking injunctive relief. The arbitration shall be governed by the U.S. Federal Arbitration Act and administered by the American Arbitration Association.

11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of California, U.S.A. Any disputes not subject to arbitration under Section 10 shall be resolved in the courts of San Francisco County, California or the U.S. District Court for the Northern District of California.

12. General Terms

We reserve the right to modify these Terms with notice. Your continued use of Dream Account after such modifications constitutes acceptance of the new Terms. These Terms constitute the entire agreement between you and TheHouse48 regarding Dream Account.

We These Terms of Service ("Terms") govern your access to and use of the House48 website, online marketplace, apps, APIs, and widgets ("House48" or the "Service"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using the House48 Online Marketplace, you agree to be bound by these Terms, our Privacy Policy, our Cookies Policy and our Community Guidelines.

1. Our Service

The House48 Online Marketplace enables seamless buying, selling, upgrading and auctioning of properties anywhere in the world. We provide features like property search, filters, exploration by country, recommended properties, and property type categories to help you find your desired real estate listings. Some property listings are promoted by users or partners. We try to ensure that even promoted content is relevant and interesting to you.

2. Using the Online Marketplace

a. Who can use
You may use the Online Marketplace only if you can legally form a binding contract with House48, and only in compliance with these Terms and applicable laws. When you create your account, you must provide accurate and complete information. The Marketplace cannot be used by anyone under 13 or where prohibited by sanctions. EEA users must be over the age allowing data processing consent in their country.

b. Our license to you
Subject to these Terms and policies, we grant you a limited, non-exclusive, non-transferable license to use our Service.

c. Commercial Use
For commercial purposes, you must create a business account and agree to our Business Terms of Service.

3. Your Content

a. Posting content:

The Marketplace allows you to post content like photos, comments, and links as "User Content." You retain rights in your User Content.

b. Use by House48 and others:

You grant House48 and users a non-exclusive, royalty-free license to use your User Content to operate, develop, and provide the Marketplace. We may remove or modify User Content per these Terms.

c. Content retention:

We may keep your User Content for backup purposes after account termination/deactivation. Other users' saved/shared copies may remain.

d. Feedback:

We appreciate feedback to improve the Marketplace and can use it freely.

4. Copyright Policy

We respect copyrights per our Copyright Policy.

5. Security

While we aim to protect your account security, ensure password security and notify us of any unauthorized use.

6. Third Party Links

The Marketplace may contain third-party links we don't endorse or assume liability for.

7. Termination

We may terminate or suspend Marketplace access for any reason with appropriate notice, or immediately if necessary like for violations.

8. Indemnity

If you use the Marketplace commercially without a proper business account, you'll indemnify House48 from any claims related to your use.

9. Disclaimers

The Marketplace is provided "as is" without warranties. We don't control User Content.

10. Limitation of Liability

House48's total liability is limited. We're not liable for various damages or losses.

11. Arbitration

For disputes, you agree to first contact us to resolve them informally. Remaining disputes must be resolved via arbitration or small claims court.

12. Governing Law

These Terms are governed by California law. Jurisdiction is San Francisco unless you're an EEA consumer.

13. General

We may revise these Terms and will notify you of material changes. You can't assign these Terms. This is the entire agreement between you and House48 regarding the Service.

DREAM ACCOUNT COMMUNITY GUIDELINES

At Dream Account, our mission is to foster a positive, inspiring environment for all community members to explore and manifest their dreams responsibly and legally. These Community Guidelines outline what is and isn't permitted on our platform:

Content Safety

Dream Account prohibits antagonistic, explicit, false, misleading, harmful, hateful, or violent content or behavior. We may remove such content and take action against accounts that create or spread it.

Adult Content

Dream Account strictly prohibits pornography and most nudity. While some artistic or educational nudity may be permitted, we limit distribution of mature and explicit content involving nudity, sexualized material, graphic sexual activity, and fetish imagery.

Exploitation

We do not tolerate exploitation of people or animals, including practices risking harm, non-consensual images, sexual services, human trafficking, slavery, forced labor, illegal commercial exploitation, and endangering wildlife sales.

Hateful Activities

Dream Account does not allow hateful content promoting violence, attacks, slurs, negative stereotypes against individuals or groups based on protected characteristics like race, ethnicity, religion, gender identity, sexual orientation or disability.

Misinformation

To promote trust, we prohibit false or misleading content that may cause harm, including medically unsupported health claims, conspiracy theories, disinformation about individuals/groups, and coordinated disinformation campaigns.

Civic & Election Misinformation

We combat misinformation undermining civic processes like elections and census participation by prohibiting false content about voting procedures, dates, eligibility, voter suppression efforts and threats to public safety.

Climate Misinformation

As part of our environmental commitment, we do not allow climate misinformation denying climate change's existence/impacts, misrepresenting scientific data, or undermining trust in climate science.

Harassment & Criticism

Dream Account allows respectful criticism but prohibits harassment intended to insult, antagonize or shame others, including manipulated media, body shaming, sexualized attacks and mocking personal experiences.

Child Safety

We have zero tolerance for child exploitation or endangerment, including illegal child sexual abuse material, sexualizing minors and facilitating unsolicited contact with children.

Private Information

Respecting user privacy, we prohibit distributing others' personal, sensitive information like identification, contacts, financial/medical data or private photos without consent.

Self-Injury & Harmful Behavior

To provide a supportive environment, we do not allow promoting self-injury, suicide, eating disorders, substance abuse through instructions, graphic content or negative self-talk.

Graphic Violence & Threats

Dream Account does not permit content showing or glorifying violence or threats of violence against individuals or groups through disturbing imagery or threatening language.

Violent Actors

We prohibit any content supporting or promoting violent extremists, terrorist groups or criminal organizations posing threats to public safety.

Dangerous Goods & Activities

Promoting regulated goods, lethal substances/weapons, harmful pranks/challenges and dangerous behaviors like drug use or gambling is not allowed on Dream Account.

Harmful/Deceptive Practices

To protect our community, we prohibit promotion of hacking tools, online gambling, counterfeit documents and exploitative financial scams.

Impersonation

Dream Account does not tolerate impersonation or misrepresentation of identity and affiliation with individuals, brands or organizations without disclosure.

Comments

These guidelines apply to comments, and we may remove violating comments containing spam, explicit content, misinformation, hateful activities, harassment or copyright violations.

Intellectual Property

We respect intellectual property rights, so violations like copyright/trademark infringement are prohibited. Use of the Dream Account brand requires proper authorization.

Site Security & Access

Unauthorized access, tampering or misuse of Dream Account's systems that compromise security or functionality is not permitted.

Spam

Spam and spammy behavior detracting from the user experience is prohibited on Dream Account.

TRADE ASSURANCE

Purchasing property is a significant investment. At Thehouse48, we prioritize your safety and satisfaction through our Trade Assurance program:

- Safe Purchases: To ensure a secure transaction, conduct all communications and payments through Thehouse48.com, protecting you via Trade Assurance.

- Trade Assurance Protection: If the property differs from the agreed terms in the online purchase, we will assist in reaching a satisfactory resolution, including facilitating a refund if necessary.

- Payment Options: We support various payment methods, including insurance and mortgage services, providing flexible financing for buyers.

- Security: We employ the latest technology to secure your payments and allow you to track fund transfers in our Transaction Center.

- Extended Support: If unsatisfied within 48 hours of purchase completion, you may request a refund investigation, mediation and reimbursement if appropriate.

By keeping transactions on Thehouse48.com and using Trade Assurance, you can make property purchases with confidence and security.

THE HOUSE48 COPYRIGHT POLICY

Thehouse48 respects intellectual property rights and responds promptly to valid copyright infringement claims regarding content on our platform. In compliance with the Digital Millennium Copyright Act (DMCA), we have implemented the following process:

Reporting Copyright Infringement

Copyright owners can report alleged infringements by providing the required information to our designated copyright agent.

Submit a Copyright Infringement Report

To submit a report, please provide:

• Identification of the copyrighted work(s)
• URL(s) of the infringing Thehouse48 content
• Your contact information
• These statements:
• "I have a good faith belief that use of the material is not authorized by the copyright owner or law."
• "This notice is accurate, and under penalty of perjury, I am authorized to act on the copyright owner's behalf."
• Your electronic signature

For images, request "remove all Pins containing the image" to remove identical copies.

Note: Fraudulent reports may have legal/financial consequences. Ensure a good faith belief before submitting.

Removal & Counter Notification

If your content is removed based on a copyright report, we can forward that report to you upon request. You may file a counter notification if you believe the removal was an error. However, false counter notifications also carry potential repercussions.

Repeat Infringers Policy

We may disable accounts with repeated copyright infringement claims, per our repeat infringer policy.

Appeal Copyright Strikes

If unable or unwilling to counter notify but believe a strike removal is warranted, you can appeal with details for our review.

Content Claiming Portal

Our Content Claiming Portal allows approved copyright holders to claim original works and decide if/how they appear on Thehouse48.

TERMS AND CONDITIONS FOR MARKETPLACE

1. Introduction

These Terms govern the use of the Thehouse48.com eCommerce marketplace and related services for buying and selling properties globally.

2. Account and Registration

You are responsible for maintaining confidentiality of your User ID and Password. Providing untrue or incomplete information gives Thehouse48 grounds to suspend or terminate your account access.

3. Sale Terms

The marketplace facilitates sales between buyers and sellers, with binding contracts formed upon a buyer's purchase confirmation. Sellers' terms govern sales, but certain provisions are incorporated:

• Price is as listed, inclusive of taxes and compliant with laws.
• Seller warrants sole legal ownership free of encumbrances.
• Payments must be made through designated Thehouse48 platforms.

4. Content Rules

Your content must be truthful, legal, and inoffensive, respecting intellectual property, privacy, and contractual rights. Prohibited content includes illegal, defamatory, explicit, hateful or spam material.

5. License to Your Content

You grant Thehouse48 a worldwide, royalty-free license to use your content across marketing channels and media for providing marketplace services.

6. Website and Mobile App Use

Permissible activities are viewing, downloading for caching, printing pages for personal use, streaming media, and using services via a web browser. Prohibited activities include unauthorized downloading, editing, re-publishing, selling, public display or commercial use of content without permission.

7. Indemnification

You indemnify Thehouse48 against losses, damages and liabilities arising from your marketplace use or content violations.

8. Terms Enforcement

Thehouse48 may suspend access, pursue legal action or request service provider blocking for any Terms violations.

9. General Provisions

These Terms constitute the entire agreement, governed by laws of the applicable territory, and subject to variation by Thehouse48. Unenforceable provisions will be limited or severed as minimally required.

10. Third-Party Rights and Assignment

Only Thehouse48 and you are parties to these Terms, which are not assignable by you without consent.

To achieve this, we personalize the content and ads you see based on information we collect from you and third parties. WE COLLECT INFORMATION IN A FEW DIFFERENT WAYS

1. When you give it to us or give us permission to obtain it

When you register for or use the House48 service, you have the choice to provide certain personal information such as your name, email address, phone number, photos, Pins, comments, and any other details you wish to share with us. Additionally, you may opt to share your precise location using your device settings or through photos. Even if you choose not to disclose your exact location, we will still use your IP address to estimate it. Moreover, you may also share other details like your gender, age, and preferred language if you prefer to do so.

If you link your TheHouse48 account to your Facebook, Google, or other third-party accounts, we may access data from those accounts such as your friends or contacts to enhance your House48 experience. However, this is subject to the privacy policies or settings of those accounts.

2. We also get technical information when you use TheHouse48

When using House48, certain internet and electronic network activity information is automatically logged, as with any website or mobile application. This information includes log data, which consists of details such as your Internet Protocol address, browser type and settings, searches, and how you use House48. We also use cookies or similar technologies to collect cookie data, such as your language preferences or other settings. Additionally, we collect information about the device you're using, such as the type of device, operating system, and unique identifiers.

Finally, we analyze your activity on House48 to make inferences about your preferences and interests, based on the Pins you click on, boards you create, and any text you add in comments or descriptions. These inferences may include information about your education or professional experience, and can be further informed by linking your House48 account to third-party accounts like Facebook or Google.

3. Our partners and advertisers share information with us

We receive information about your activities outside of House48 from our affiliates, partners, advertisers, and other third parties that we collaborate with. This includes data that we collect from websites or apps that use House48 features, such as our "Save" button, or from our own "Save" button that you install on your browser. In addition, we receive information from online advertisers or third parties to enhance the performance of ads on House48, including your visits to an advertiser's site or your purchases, and to determine the type of ads that are relevant to you. We provide you with options to control how we use this information to personalize your experience and the ads you see on House48 in your Privacy and Data Settings. WHAT WE DO WITH THE INFO WE COLLECT

At House48, we use your information to personalize your experience and improve our product features to make your inspiration-seeking easier and more enjoyable. This includes identifying you when you use House48, recommending posts, and topics that you might like based on your activity, responding to your questions or comments, and suggesting other users and contacts who share similar interests. We also prioritize making House48 safe and secure by reviewing messages and collaborating with law enforcement authorities to identify potential risks to our users and the public.

To further enhance our services, we use analytics and research to understand how people use House48 and develop new features that are tailored to your interests. We also deliver ads that are relevant and interesting to you, generating revenue that allows us to keep our services free. To do this, we use the information we collect to customize ad content and decide which ads to show you. We may also share ad performance information with our partners to improve their ads and provide you with a better experience. You have control over the information we use to personalize ads for you and can manage your settings in our Privacy and Data Settings.

House48 has a legitimate interest in using the information they collect to personalize your experience on the platform by identifying your offsite behavior and suggesting relevant content, such as Pins related to websites you have visited. In such cases, they (or their partners) will obtain necessary consent. However, in other cases, House48 will only use your information with your explicit consent, such as for allowing searching with photos, sending marketing materials, customizing recommendations and ads based on your location, and reporting to ad partners about the performance of their ads using the House48 Tag. Additionally, where House48 uses cookies to show you ads based on your offsite activity, they will obtain your consent as required. TRANSFERRING YOUR INFORMATION

When you use House48's products or services, you are giving us permission to transfer and store your information outside of your home country, which may include the United States. This is necessary for us to fulfill the purposes outlined in our policy. However, it's important to note that the privacy laws and regulations in these countries may not provide the same level of protection as those in your home country. Additionally, authorities in these countries may have different rights to access your personal information.

CHOICES YOU HAVE ABOUT YOUR INFO

We aim to offer you simple and meaningful options regarding your information. If you have a House48 account, you can access many of these controls directly through House48 or your account settings. For instance, you can:

- Modify your profile information at any time, choose whether search engines can access your profile, and decide if others can locate your House48 account using your email address.

- Connect or disconnect your House48 account from other services like Facebook, Google, or Twitter. For some services, such as Facebook, you can also decide if you want to publish your House48 activity on that service.

- Manage secret board settings. These boards are visible to you and other board collaborators, and any collaborator can make the board available to anyone else. For example, a collaborator can invite someone new to the board or take an image from the board and share it via email.

- Decide if you want House48 ads that appear on other platforms, websites, or apps to be customized based on your account activities. You can control this by updating your "Personalization" preferences in your settings.

- Choose if you want House48 to share information about your activity on the platform for ad performance reporting. You can adjust this by updating your "Data Personalization" preferences in your settings.

- Close your account anytime. When you close your account, we will deactivate it, remove your boards and Pins, and delete your account data. Please note that we may need to keep your data for legal reasons, such as if we receive a law enforcement request asking us to preserve data. We may also keep some information in our backup systems for a limited time or as required by law.

Additionally, you have choices available to you through the device or software you use to access House48, such as controlling cookies or choosing how and whether your location, photos, contacts, and other data are shared with us. For more information on these options, please refer to the information provided by your device or software provider.

HOW AND WHEN WE SHARE INFORMATION

When you use House48, certain information about you is visible to other users and can be accessed through APIs, which are technical tools for sharing information. This includes your public boards and Pins, as well as your profile information. For example, a partner may use a House48 API to study their most popular posts or how their posts are being shared on House48.

In addition to making this public information available through APIs, we may also share your information with other services at your direction. This may include services that you use to sign up for or log in to House48, or services that you choose to link your House48 account to, such as Facebook or Google. When you publish your content on House48 to those services, information about that content will be shared with those services.
